Terms of Service

1. Who we are

StagingLens ("the App") is a product of Nona Video LLC, a Florida limited liability company ("we," "us"). These Terms of Service ("Terms") are an agreement between you and Nona Video LLC. By downloading, installing or using the App, or by purchasing a subscription, you agree to these Terms.

2. Your license

While your subscription or free trial is active, we grant you a limited, non-exclusive, non-transferable license to install and use the App for your own business, including staging photos for your clients. You may not resell, sublicense, share your license key, reverse engineer the App, or attempt to extract or copy its built-in staging instructions, except where the law expressly allows it.

3. Subscriptions, trials and billing

• StagingLens is sold as a monthly or annual subscription. Orders are processed by our reseller, Lemon Squeezy, which acts as the merchant of record and handles payment, sales tax and invoicing.
• New subscriptions include a 14-day free trial. You enter payment details at checkout, and you are charged automatically when the trial ends unless you cancel before then.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel anytime through the customer portal link in your receipt email; your access continues until the end of the period you've paid for.
• We may change prices for future billing periods. We'll notify you by email before a price change affects you, and you can cancel before it takes effect.
• Refunds are covered by our Refund Policy.

4. Your OpenAI account

• The App uses OpenAI image models through an OpenAI API key that you provide. You need your own OpenAI account with API billing enabled. API billing is separate from any ChatGPT subscription.
• OpenAI charges you directly for image generation. Those charges are between you and OpenAI; we don't receive, control or refund them. Any cost estimates we publish are approximate and depend on OpenAI's current rates and how you use the App.
• You're responsible for keeping your API key secure and for complying with OpenAI's terms and usage policies.
• OpenAI may change, limit or discontinue its models or services at any time. We'll make reasonable efforts to update the App when that happens, but we can't guarantee the availability, pricing or output of OpenAI's services.

5. Your photos and results

You keep all rights to the photos you process and the staged images you create. We don't claim ownership of them. You confirm that you have the right to edit the photos you use with the App.

6. Responsible use and MLS disclosure

• Virtually staged images are marketing illustrations. You're responsible for reviewing every image before use and for making sure it doesn't misrepresent a property's condition, size, features or defects.
• You're responsible for complying with all laws, MLS rules and brokerage policies that apply to your listings, including disclosing that images are virtually staged and providing access to the original photos where required. The App's disclosure options are tools to help you; they don't guarantee compliance.
• You may not use the App for anything unlawful, deceptive or harmful, or in a way that violates OpenAI's usage policies.

7. AI output

AI-generated images can contain errors, including changes to architecture, fixtures or details that weren't intended. The App is designed to minimize this, but results aren't guaranteed. Review each image carefully and use the App's retry and revision tools as needed.

8. Updates and support

Your subscription includes App updates and email support. We may add, change or remove features over time. We aim to reply to support requests within two business days.

9. Disclaimers

The App is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the App will be uninterrupted, error-free or that any output will meet your requirements.

10. Limitation of liability

To the fullest extent allowed by law, Nona Video LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the App or these Terms is limited to the amount you paid us for StagingLens in the 12 months before the claim arose.

11. Indemnity

You agree to defend and indemnify Nona Video LLC against claims arising from your use of the App, the images you create, your listings, or your violation of these Terms or any law, MLS rule or third-party right.

12. Termination

You can stop using the App and cancel anytime. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination, including 5, 6, 9, 10, 11 and 13, will survive.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll post the new Terms here and update the effective date, and we'll notify active subscribers by email. Continuing to use the App after changes take effect means you accept them.
